By accessing or using ClassClicker, you agree to these Terms of Service. Please read them carefully. ClassClicker is operated by a sole proprietor based in Kanagawa, Japan. In these Terms, “ClassClicker,” “we,” “us,” and “our” refer to the ClassClicker website, applications, and services.
You may use our Service only in compliance with these Terms and applicable law. Don’t misuse our Service. For example, don’t interfere with the normal operation of the Service, attempt to gain unauthorized access to the Service or other users’ accounts, or access the Service using a method other than the interfaces and instructions that we provide.
We may suspend or restrict access to the Service if you do not comply with these Terms or our policies, if we are investigating suspected misconduct, or if we reasonably believe that your use of the Service may cause harm to the Service, other users, or third parties.
Using our Service does not give you ownership of any intellectual property rights in the Service or in content belonging to other users. You may not use content from our Service unless you have permission from its owner or are otherwise permitted by law.
These Terms do not grant you the right to use ClassClicker’s trademarks, branding, logos, or other proprietary materials. Don’t remove, obscure, or alter legal notices displayed in or along with the Service.
We may review, remove, restrict, or refuse to display content that we reasonably believe violates these Terms, our policies, the rights of others, or applicable law.
ClassClicker reserves the right to limit or restrict activity that consumes a disproportionate amount of system resources or bandwidth, interferes with other users, or adversely affects the availability, security, or operation of the Service.
You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs through your ClassClicker Account. You should use a secure password and notify us if you believe your account has been accessed without authorization.
You are responsible for providing accurate account information and keeping that information reasonably up to date.
Certain account information may be displayed publicly when you choose to publish content or results through ClassClicker, as described in the “Public Content” section below.
If you use ClassClicker on behalf of a school, organization, company, or other entity, you represent that you have authority to use the Service on behalf of that entity and are responsible for complying with any policies and legal requirements that apply to your use of the Service.
ClassClicker offers Free, Plus, and Team plans. The Free plan is available without a subscription fee and may be subject to usage limits. The features and limits applicable to each plan are described on our plan and pricing pages.
Plus and Team plans are paid subscription plans and are billed annually. The applicable subscription price, features, limits, and billing period will be displayed before you complete your purchase.
The Team plan is available with different capacity options. The price of a Team subscription depends on the capacity selected. Available Team capacity options, features, and prices are shown on the ClassClicker plan page.
Unless you cancel your paid subscription before its next renewal date, your subscription will automatically renew for another annual billing period and the applicable subscription fee will be charged using the payment method associated with your subscription.
Paid ClassClicker subscriptions are sold and processed through Paddle. Paddle acts as the Merchant of Record for these transactions. When you purchase a paid subscription, your transaction is also subject to Paddle’s applicable buyer terms and policies.
The final amount charged may include applicable taxes, such as sales tax, VAT, or GST. Applicable taxes and the final amount payable will be shown during checkout.
You authorize Paddle to charge the applicable subscription fees and taxes to the payment method you provide. You are responsible for keeping your billing and payment information current.
You may cancel a paid subscription through the subscription management service provided by Paddle. Unless otherwise required by applicable law, cancellation takes effect at the end of your current paid subscription period.
You may continue to use the features of your paid plan until the end of that period. Canceling a subscription prevents future renewals but does not automatically result in a refund.
Refunds are handled in accordance with our Refund Policy, Paddle’s applicable policies, and applicable law.
Nothing in these Terms limits any refund, withdrawal, cancellation, or other consumer rights that cannot legally be excluded or limited.
We may allow you to change your subscription plan or Team capacity. When a plan change is available, any applicable price change, charge, credit, and effective date will be shown or communicated as part of the plan change process.
We may change the prices, features, or limits of our plans from time to time. Changes will not retroactively alter amounts already paid for a completed transaction. Where required by applicable law, we will provide notice before a pricing change applies to a future subscription renewal.
Our Service includes content created or provided by users. Such content remains the responsibility of the person or entity that makes it available. ClassClicker does not claim ownership of intellectual property rights in content that you create or upload to the Service.
You retain ownership of the content you provide to ClassClicker, subject to any rights you may grant to a Team, organization, or other users through features of the Service.
When you upload, submit, store, send, or otherwise provide content through the Service, you grant ClassClicker a worldwide, non-exclusive license to host, store, reproduce, process, display, and otherwise use that content only as reasonably necessary to provide, maintain, secure, support, and improve the Service.
You are responsible for ensuring that you have the rights and permissions necessary to provide content to the Service and to allow ClassClicker to process that content as described in these Terms.
ClassClicker allows users to create, share, and manage content within a Team. Content assigned or shared as Team content may be accessible to authorized members and administrators of that Team in accordance with the features and permissions provided by the Service.
Team content is intended to remain available to the Team even if the user who originally created or owned that content leaves the Team or is no longer able to use the Service. Where supported by the Service, ownership or responsibility for Team content may be reassigned to another authorized Team member.
If you add or assign content to a Team, you acknowledge that authorized Team administrators or other authorized Team members may continue to access, use, manage, or reassign that content after you leave the Team.
Team administrators are responsible for managing Team membership, permissions, and Team resources appropriately. ClassClicker is not responsible for disputes between members of a Team or between users and the school, organization, company, or other entity associated with a Team.
Some ClassClicker features allow you to make content publicly available. If you choose to publish content publicly, other users may be able to view or access that content through the Service.
You are responsible for ensuring that content you make public does not violate applicable law, intellectual property rights, privacy rights, or other rights of third parties.
You may change or remove content that you have made public where the Service provides controls for doing so. Copies or references created by other users before the content is removed may not always be automatically removed where separate copies or resources have been created through permitted features of the Service.
If you submit feedback, ideas, or suggestions about ClassClicker, we may use them without restriction or obligation to you. You are not required to provide feedback.
Our Privacy Policy explains how ClassClicker collects, uses, and protects personal information in connection with the Service. By using ClassClicker, you acknowledge that your personal information will be handled as described in our Privacy Policy and in accordance with applicable law.
If you use ClassClicker in connection with students, employees, or other individuals, you are responsible for obtaining any permissions or consents required for the information and content that you provide to the Service.
ClassClicker may modify, supplement, expand, or improve the Service from time to time. We may also change or introduce features, usage limits, or technical requirements.
We may suspend or discontinue all or part of the Service. Where reasonably practicable, we will provide notice of material changes that significantly affect paid features. We may make changes without advance notice where necessary for security, legal, operational, or technical reasons.
You may stop using ClassClicker at any time. Any paid subscription should also be canceled through the applicable subscription management process if you do not want it to renew.
We may suspend or terminate access to the Service if you materially or repeatedly violate these Terms, create risk or possible legal exposure for ClassClicker or other users, misuse the Service, or where suspension or termination is reasonably necessary to protect the security or operation of the Service.
Where appropriate and reasonably practicable, we will provide notice before terminating an account and an opportunity to address the issue. We may act immediately where necessary for security, legal, or operational reasons.
Termination of an individual user’s account does not necessarily result in deletion of content that has been assigned to or retained as a resource of a Team. Team content may continue to be available to authorized Team members as described in these Terms.
ClassClicker may use or provide access to services operated by third parties, including payment and infrastructure providers. Your use of a third-party service may also be subject to the terms and policies of that third party.
ClassClicker is not responsible for third-party services that are outside our control, except to the extent responsibility cannot be excluded under applicable law.
Other than as expressly stated in these Terms or additional terms, and to the extent permitted by law, ClassClicker makes no specific promises or warranties about the Service.
For example, we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free, or that particular features will always remain available. We also do not guarantee the accuracy, completeness, or reliability of content provided by users.
To the extent permitted by law, the Service is provided “as is” and “as available.”
The Service may contain content uploaded or provided by users that violates privacy, publicity, intellectual property, or other rights of third parties. ClassClicker does not endorse user-provided content and, to the extent permitted by law, is not responsible for harm arising from content provided by users.
To the extent permitted by law, ClassClicker and its suppliers and service providers will not be responsible for lost profits, revenues, business opportunities, or data, or for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Service.
To the extent permitted by law, the total liability of ClassClicker and its suppliers and service providers for claims arising out of or relating to these Terms or the Service will not exceed the amount you paid for ClassClicker during the twelve months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability or legal rights that cannot lawfully be excluded or limited.
To the extent permitted by law, you agree to indemnify and hold harmless ClassClicker and its affiliates, officers, agents, employees, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use or misuse of the Service, your violation of these Terms, or content you provide that infringes the rights of another person or entity.
These Terms are governed by the laws of Japan, without regard to its conflict of laws principles.
Any disputes arising out of or relating to these Terms or the Service will be subject to the jurisdiction of the courts of Japan, except where applicable law provides otherwise.
Nothing in these Terms limits any rights you may have under mandatory consumer protection laws that apply to you.
We may modify these Terms from time to time, for example, to reflect changes to the law, changes to the Service, new features, or changes to our business practices.
Changes will not apply retroactively unless required by law. Material changes will become effective no sooner than fourteen days after they are posted unless a shorter period is necessary for legal, security, or operational reasons. Changes relating to new features or changes required by law may become effective immediately.
You should review these Terms periodically. If you do not agree to revised Terms, you should discontinue your use of the Service. Your continued use of the Service after revised Terms become effective constitutes your acceptance of those Terms.
If you do not comply with these Terms and we do not take action immediately, this does not mean that we are giving up any rights that we may have, including the right to take action in the future.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
